Terms of Service

1. Acceptance of Terms

By downloading, installing, accessing, registering, or using GlobalChat 365 (whether via our native Android application, iOS platform, or web application at globalchat365.online), you enter into a legally binding contract with Shubham X Infotech (founded by Shubham Chawda) and agree to abide strictly by these Terms of Service. If you do not agree to these terms in full, you must discontinue using GlobalChat 365 immediately.

2. Eligibility & Account Integrity

To use GlobalChat 365, you must satisfy the following conditions:

• Age Requirement: You must be at least 18 years of age or the age of legal majority in your country of residence to register an account.
• Credential Security: You are solely responsible for maintaining the confidentiality of your username, email credentials, and biometric/PIN locks. You agree to notify us immediately of any unauthorized breach.
• Authentic Identity: You agree not to impersonate any individual, brand, organization, or public figure.

3. Acceptable Use & Zero-Tolerance Abuse Policy

GlobalChat 365 is built for respectful, authentic, and lawful communication. We maintain a strict zero-tolerance policy for abusive, harmful, or objectionable behavior. You explicitly agree NOT to:

• Harass, stalk, threaten, defame, bully, or intimidate any user, group, or community member.
• Transmit sexually explicit material, non-consensual content, child exploitation material, or violence.
• Distribute unsolicited bulk spam, automated bot promotions, phishing links, or financial scams.
• Inject software viruses, worms, malware, or malicious payloads into the system.
• Decompile, reverse-engineer, packet-sniff, scrape, or attack our server infrastructure via Denial of Service (DDoS).
• Infringe on trademarks, copyrights, or other intellectual property rights.

Enforcement: Violations of this policy result in immediate, permanent account termination and device-level hardware banning without prior warning or eligibility for refunds.

4. User Content Ownership & Intellectual Property

You retain 100% intellectual property ownership of all text messages, uploaded photographs, videos, voice notes, and canvas doodle sketches you transmit across the platform. GlobalChat 365 and Shubham X Infotech claim zero copyright or commercial ownership over your content.

Unlike traditional social media monopolies, we do NOT demand a perpetual, royalty-free worldwide license to monetize, broadcast, or commercialize your personal creations.

5. Zero-Surveillance & No-AI-Training Covenant

As part of this agreement, Shubham X Infotech covenants that:

• Your messages, media files, and communications will never be sold, traded, or shared with third parties or data brokers.
• Your messages, voice notes, and private files will never be used to train AI models or machine learning algorithms.
• You will never be served suggested advertisements or behavioral tracking feeds on GlobalChat 365.

6. VIP Memberships, Cosmetic Perks & Creator Tips

GlobalChat 365 provides optional digital passes (e.g. VIP supporter badges, pastel theme styling, custom app launcher icons, and extended file limits). VIP benefits are strictly tied to your account, non-transferable, and governed by our Refund & Cancellation Policy.

7. Service Availability & Limitation of Liability

While our engineering team works diligently to deliver 99.9% uptime and millisecond response times, GlobalChat 365 is provided on an "as is" and "as available" basis. To the maximum extent permitted under applicable law, Shubham X Infotech and its founder shall not be liable for indirect, incidental, punitive, or consequential damages resulting from network interruptions or service maintenance.

8. Account Deletion & Right to Terminate

You may terminate your account at any moment. Permanent data erasure can be initiated directly in-app (Settings → Profile Card → Delete Account) or via our public Web Account Deletion Portal. Upon verification, all records are permanently erased.

9. Governing Law & Exclusive Jurisdiction

These Terms shall be governed by, construed, and enforced in accordance with the substantive laws of India. Any legal dispute, arbitration, or proceeding arising under or in relation to these Terms shall be subject to the exclusive jurisdiction of the competent courts located in Gandhidham, Gujarat, India.
